1. Ownership of the site
The website www.perledisale.com is owned by Perle di Sale srl, located in Via Europa, 24 24060 Bolgare (Bergamo) - ITALY - VAT and Tax Code: 04319010163, subscribed to the Register of Companies in Bergamo - (hereinafter "Perle di Sale"). The website is aimed at the retail sale of online products and services.
2. Scope of application
These General Conditions of Sales (hereinafter "General Conditions of Sales") concern the sale of products and services on the website www.perledisale.com (hereinafter "Site") in the version published at the time of the order.
These General Terms and Conditions of Sale along with the conditions regarding the methods of payment and delivery of goods, are an integral part of the sales contract concluded between the Customer and Perle di Sale.
The offer of products and services on the website www.perledisale.com is addressed exclusively to natural and legal persons, who do not trade in the exercise of a commercial activity.
Perle di Sale does not sell products to children, who can proceed with the purchase of products only by involving a parent or legal guardian; the Customer assumes all responsibility for any untruthful information in this regard.
Perle di Sale invites the Customer to carefully read these General Terms and Conditions of Sale before proceeding with any purchase, to print them or otherwise to keep a copy of them.
By making any purchase in the manners provided for on the Site, in the "Customer Support" section, the Customer declares to have read all the information provided during the purchase procedure and to fully accept the General Conditions of Sale, payment and delivery.
3. Applicable law
The sale of products and services by electronic means is governed by articles 45 to 67 "Consumer Rights" of Legislative Decree 6 September 2005 n. 206 (Consumer Code) and any following change and/or amend and by Legislative Decree 9 April 2003 n. 70 in the field of electronic commerce. The sales contract stipulated between the Customer and Perle di Sale will be regulated and interpreted in accordance with Italian Law.
4. The Contract of Sale - Methods of purchase
4.1. In order to make purchases, the Customer must be registered on the Site.
4.2. The presentation of products and services on the Site or through the application of Perle di Sale for mobile devices constitutes an invitation to purchase.
4.3. The Customer can purchase the products visible at http://www.perledisale.com/, illustrated on the homepage of the Site within the respective sections by product category, as described in the relative information sheets.
4.4. Only orders that require billing and delivery on the Italian territory are accepted.
4.5. The products published on the Site can be:
"available", i.e. physically in stock and therefore, as such, can be ordered by the Customer;
"not available" in stock: in this case the product cannot be ordered by the Customer and, if he so wishes, he can leave his e-mail address to be notified if the product itself becomes available again;
"on order": in this case the product can be ordered by the Customer even if it is not physically available in the warehouse. Perle di sale will arrange to order the article chosen by the Customer from its supplier. The time required for the reception of these products by Perle di Sale varies between 3 and 20 Working Days, and are however expressly indicated on the cart pages.
4.6. When the purchase order is made, the Customer has the option of choosing the payment and delivery method he prefers.
The Customer's purchase order will therefore be considered as a contractual purchase proposal addressed to Perle di Sale for the listed products, each considered individually. Upon receipt of the purchase order, Perle di sale will automatically send an e-mail confirming the acceptance of the order ("Presa in loading order").
The Customer undertakes to verify the correctness of the data present in the e-mail confirming the Order in Load and to promptly report to Perle di sale any system errors.
The order confirmation e-mail containing the order contains the following data:
Order number and date
Product/s, quantity, price
Payment method chosen
Shipping charges
Total order amount
4.7. The sales contract between the Customer and Perle di Sale will be concluded only when Perle di sale sends the Customer a separate e-mail containing the information concerning the shipment of the product and the invoice and which constitutes the acceptance of the purchase proposal of the Customer ("Shipping Confirmation"). The charge will only take place when the products included in the Customer's order will be shipped. The right of withdrawal of the Customer is in any case subject to the terms and conditions of the section on the Site.
4.8. Perle di Sale, due to the nature of the internet, cannot guarantee uninterrupted access and the absence of errors in the transmission of services. Furthermore, access to the Site and / or services offered by Perle di sale may be occasionally suspended or limited to allow repairs, maintenance or the introduction of new products or services. Perle di Sale will attempt to limit the frequency and duration of such suspensions and / or limitations.
4.9. Until the shipment confirmation email referred to in Article is sent. 4.7. above, Perle di Sale will not be liable for any delay or failure (including cancellation of the order) to the obligations set forth in these General Terms and Conditions of Sale and Payment and Delivery, if the delay or the breach derives from a fortuitous event or from causes of force majeure. This provision does not affect the rights of the Customer provided for by the law and in particular the right of the Customer to receive the products purchased within a reasonable time or to be reimbursed in the event of non-delivery due to circumstances arising from unforeseeable circumstances or for reasons of force majeure.
5. Prices
The sales prices of the products published on the Site include VAT. Perle di Sale declares that the prices are those indicated on the Site, guaranteeing the controls of the correctness of the prices. If, due to mistakes or other problems attributable to the functioning of computer systems, a price different from the actual one ("Obstacle error") is indicated by mistake, "Perle di Sale" will contact the Customer to verify if he also wants to buy the product at the correct price, otherwise the order cannot be processed.
6. Competent Court
For the resolution of any civil disputes arising from the interpretation, execution and termination of this distance selling contract, if the Customer is a consumer (i.e. a natural person who purchases the products not for purposes related to his professional activity) the territorial competence it is mandatory for the judge of the place of residence or domicile of the consumer, if located in Italy (Art. 63 Legislative Decree 205/2006).
7. Changes to the General Conditions of Sales
Perle di Sale reserves the right to modify the Site, the policies and these General Terms and Conditions of Sale at any time to offer new products or services, or to comply with legal or regulatory provisions. The Customer will be subject to the policies and terms of the General Conditions of Sale from time to time in force when ordering products from Perle di Sale, unless any changes to these policies and to these terms are not required by applicable law or by the competent authorities (in which case, they will also apply to orders previously placed by the Customer). If any provision of these General Terms and Conditions of Sale is deemed invalid, void or for any reason unenforceable, this condition will not affect the validity and effectiveness of the other provisions.
Any changes and/or additions will be effective from the date of publication of the same on the website http://www.perledisale.com/.
